The Town Green at Markham and Little Francis is Weymouth is approx. 42 acres of an area known as Curtis Fields. It is a wildlife haven with many wild flowers (the cowslips have been magnificent this year), a small resident heard of deer (including a young one this spring), buzzards, owls, badgers and much more. Having been used for many years by the local community for recreational purposes it was registered as a Town Green in 2000.
This meant that the local residents could use the fields as of right and were not trespassing if they strayed from the two public footpaths that cross the fields.
The current owner, a local development company, has challenged the registration using as technicality. The court upheld the challenge and deemed that the County Council applied the wrong Act of Parliament when it added the land to the Register of Town Greens. However, the judge expressed a willingness to re–examine the application for registration applying the appropriate Act of Parliament. The Society for the Protection of Markham and Little Francis was reconvened and fund raising was recommenced. The Society has engaged an eminent barrister who deals specifically with Town Green registrations and the Court case commences in Weymouth on Tuesday 8th June 2010. It will cost approximately £45,000 and through fund raising and some generous donations we are nearly there! Having gone this far with great enthusiasm from local residents, rest assured we shall be there on 8th June to continue our aim to protect this area.
They are now working hard but they need support from others:
This is the last chance we have to keep the Green. If we lose this case we will all be prevented from using this land and it could be open to future development.
